Merchants give it many names, such as dried枝 Rhododendron, dried branch flower, dried fresh flower, dried plum branch, dried peach branch... but dare not use its real name—Xing'an Rhododendron.
Wild Xing'an Rhododendron has been listed as a second-class protected plant
Jin Jiannan, a lawyer at the Beijing Hua Zhi Tao Law Firm, believes that according to Article 344 of the Criminal Law and the administrative regulation "Regulations on the Protection of Wild Plants of the People's Republic of China," the former stipulates:
"Whoever violates state regulations, illegally cuts, destroys rare trees or other plants under national key protection, or illegally purchases, transports, processes, or sells rare trees or other plants under national key protection and their products, shall be sentenced to not more than three years of fixed-term imprisonment, criminal detention, or control, and shall also be fined; if the circumstances are serious, they shall be sentenced to not less than three years but not more than seven years of fixed-term imprisonment and shall also be fined."
The "other plants under national key protection" referred to in the regulation means species listed in the "List of National Key Protected Wild Plants."
Furthermore, the "E-commerce Law" clearly stipulates that e-commerce operators shall not sell or provide goods or services prohibited by laws and administrative regulations.
